SEP <br />2 1981 800K 47 PAr,E 383 <br />ON MOTION BY COMMISSIONER FLETCHER, SECONDED BY COMMISSIONER <br />SCURLOCK, THE BOARD UNANIMOUSLY AUTHORIZED THE EXPENDITURE OF $5,000 <br />TO BE MATCHED WITH THE $5,000 PUT UP BY THE SEBASTIAN CITY COUNCIL <br />FOR THE REMOVAL OF THE HILL ON STATE ROAD 512, <br />DISCUSSION RE INDIAN RIVER SHORES ANNEXATION <br />CHAIRMAN LYONS REPORTED THAT AFTER SEVERAL DISCUSSIONS WITH <br />FRITZ GIERHART, INDIAN RIVER SHORES COUNCILMAN, HE HAD TAKEN THE <br />POSITION THAT IF INDIAN RIVER SHORES AND -THE COUNTY CAN COME UP WITH <br />AN AGREEMENT'ON THE OPERATION OF THE TRACKING STATION PARK TO ENSURE <br />ITS LONG TERM OPERATION WITH RULES THAT THE COUNTY DID NOT FIND <br />ONEROUS AND WE COULD REACH AGREEMENT ON THE GENERAL TERMS OF DEVELOP- <br />MENT, HE WOULD BE WILLING TO RECOMMEND THAT WE DO THIS; OTHERWISE, <br />HE BELIEVED WE SHOULD ASK THE ATTORNEY WHAT STEPS WE CAN TAKE TO HEAD <br />OFF THE ANNEXATION, <br />ATTORNEY COLLINS INFORMED THE BOARD THAT FRIDAY THE TOWN <br />WILL CONSIDER THE SECOND READING OF THE ORDINANCE AND FINAL ADOPTION, <br />AND AFTER THAT WE HAVE 30 DAYS TO TEST THE ACTION, HE THEN GAVE THE <br />BOARD AN OVERVIEW OF THE SITUATION, EXPLAINING WHAT HE FELT WAS THE <br />REASON FOR THE TOWN NOT INCLUDING THE TRACKING STATION PARK PROPERTY <br />IN THE PROPOSED ANNEXATION AND THE REASONS HE FELT WE COULD DEFEAT <br />THE ANNEXATION, ATTORNEY COLLINS BELIEVED THE TOWNS ATTITUDE TOWARDS <br />NEGOTIATION OF THE SITUATION WAS FAVORABLE AND NOTED THAT EVEN THOUGH <br />HE BELIEVED WE CAN DEFEAT THE ANNEXATION, WE COULD BE LOOKING AT <br />ANOTHER TWO YEARS OF LITIGATION IF WE CONTESTED IT, HE STATED THAT <br />IF THE BOARD DESIRES TO LITIGATE, HE BELIEVED THERE IS GOOD PRECEDENT <br />ON OUR SIDE; IF THE BOARD WANTS TO TRY TO RESOLVE THE MATTER--BY- <br />ALLOWING'THE FIVE ACRES TO BE ANNEXED BY THE TOWN WHICH WOULD ALLOW <br />THEM TO BRING IN PEBBLE BEACH AND THE OTHER PROPERTIES, HE BELIEVED <br />WE CAN WORKOUT AN AGREEMENT THAT DOESNIT IMPOSE A HARDSHIP AND <br />ALLOWS THE PROPERTY TO BE USED FOR PARK PURPOSES, THE ATTORNEY <br />FURTHER NOTED THAT UNDER THE SEWER AGREEMENT WE HAVE.WITH THE TOWN, <br />WHOEVER ENDS UP WITH THE PROPERTY PAYS THE CITY OF VERO BEACH THE <br />COST OF THE LINE, WHICH IS A CONSIDERABLE AMOUNT, <br />46 <br />
