INDIAN RIVER COUNTY ORDINANCE NO. 76-22 <br />AN AMENDMENT TO INDIAN RIVER COUNTY ORDINANCE 75-6 <br />RELATING TO SET BACKS ON EACH SIDE OF STATE ROAD <br />60 FROM THE WEST BOUNDARY OF THE MAIN CANAL TO <br />INTERSTATE 95 INTERCHANGE; PROVIDING FOR BUILDING <br />CONSTRUCTION SET BACKS OF AT LEAST SEVENTY-FIVE ) <br />(751) FEET FROM THE RIGHT OF WAY LINE OF STATE ROAD E <br />60; PROVIDING FOR PENALTIES; AND PROVIDING AN <br />EFFECTIVE DATE <br />BE IT ORDAINED BY THE BOARD OF COUNTY COPIMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA That Indian River County <br />Ordinance 75-6 is totally amended as follows: <br />WHEREAS, the Lard of County Commissioners of Indian <br />River County recognizes that the opening of Interstate 95 <br />through to St. Lucie County will tend to attract a corridor <br />of auto -oriented enterprises along State Road 60 and this <br />movement should be carefully regulated in order to _protect <br />the locality's main traffic accessway to Interstate 95 to <br />insure sound stabilized economic growth; and <br />I <br />WHEREAS, Indian River County is attempting to co::lply <br />with the State Comprehensive Land Use Statutes for the purposes <br />of insuring orderly development within Indian River County; and <br />WHEREAS, a rapid development of property on either.side <br />of State Road 60 would frustrate the purposes of orderly planned <br />growth within the County; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />CO.LMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA: <br />Section 1. There is hereby established a seventy-five <br />(751) foot building construction set back on all real property <br />fronting on State Road 60 from the West boundary line of the <br />Main Canal to the Interstate 95 Interchange. The required <br />set back shall be measured from the road right of way line. <br />Section 2. Anyone who violates this ordinance shall be <br />guilty of a misdemeanor and upon conviction, shall be punished <br />by a fine not exceeding Five Hundred Dollars ($500.00) or by <br />
