_X. <br />INDIAN RIVER COUNTY ORDINANCE NO. 79-3 <br />AN EMERGENCY ORDINANCE RESTRICTING THE DIVISION OF <br />SUB -DIVIDED LOTS IN APPROVED SUBDIVISIONS FOR THE <br />PURPOSE OF CREATING TWO (2) OR MORE BUILDING SITES; <br />PROVIDING FOR AN EFFECTIVE DATE <br />WHEREAS, Indian River County Ordinance 75-3 provides for <br />regulation and implementation of Subdivisions in Indian River <br />County; and <br />WHEREAS, prior well permitting regulations issued by the <br />Indian River County Health Department required a minimum of one - <br />acre sites in order to obtain a well permit; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida approved numerous one -acre subdivisions submitted <br />by developers in order to satisfy the Health Department regulations; <br />and <br />WHEREAS, County residents have purchased one -acre sites in <br />platted subdivisions expecting their home sites and those <br />surrounding them in the subdivision to remain as originally <br />platted; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida has found that it is in the best interest of the <br />public for health, safety and aesthetic reasons to prohibit <br />the division of subdivided lots where such a division results <br />in construction sites that are inconsistent in size aith the <br />surrounding platted lots in the subdivision; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That <br />ARTICLE III <br />Section 22-62 <br />The division of any lots in a platted subdivision approved <br />by the Board of County Commissioners of Indian River County, <br />Florida which results in construction sites which are smaller <br />and inconsistent with the surrounding lots in the subject <br />platted subdivision is hereby prohibited unless said division <br />of lot or lots is approved by the Board of County Commissioners of <br />
