ORDINANCE NO. 79 - 19 <br />AN EMERGENCY ORDINANCE ESTABLISHING A SIXTY <br />DAY MORATORIUM ON THE REVIEW AND ISSUANCE <br />OF ALL SITE PLANS AS PROVIDED FOR IN SECTION <br />23 OF THE INDIAN RIVER COUNTY ZONING ORDI- <br />NANCE, PROVIDING FOR APPLICATION TO A <br />LIMITED AREA, PROVIDING FOR APPROPRIATE <br />DRAINAGE STUDIES TO BE MADE FOR THE PRO- <br />TECTION OF CURRENT AND FUTURE LAND OWNERS <br />WITHIN THE SUBJECT AREA <br />WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, has received recommendations from the <br />staff, residents and other drainage experts that a critical <br />drainage problem exists within an area defined as follows: <br />That property lying within the area bounded on the <br />South by the South Relief Canal, on the West by <br />the Florida East Coast Railway East right-of-way <br />line, on the North by the South city limits of the <br />City of Vero Beach, and on the East by the West <br />shoreline of Indian River, <br />and <br />WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, in regular session deemed that an <br />emergency existed and that the normal notice requirement for <br />an ordinance should be waived in order to properly plan the <br />drainage requirements within the above defined area prior <br />to additional construction commencing, and <br />WHEREAS, this emergency ordinance shall apply only <br />to those pending and future projects which require site plan <br />approval by the Indian River County Planning and Zoning <br />Commission within the area defined, and <br />WHEREAS, the purpose of this moratorium is to provide <br />time to determine ways of minimizing flooding and define <br />methods of drainage which will best meet the health and welfare <br />needs of the citizens of Indian River County, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that a <br />moratorium of sixty days' duration, terminating sixty days <br />after enactment, is hereby established on the issuance of all <br />
