BASED ON THIS APPLICATION TO JUSTIFY THE REQUESTED VARIANCE, AND <br />FURTHER POINTED OUT THAT THE ADJACENT OWNER TO THE NORTH, WHOM HE <br />REPRESENTS, HAS NO INTENTION OF SUBDIVIDING AND NO INTENTION OF <br />GOING ALONG WITH THE RECOMMENDATION OF STAFF THAT THEY AT SOME FUTURE <br />TIME CONTRIBUTE 25' ON THE SOUTH OF THEIR PROPERTY TO MAKE UP THE <br />PROPOSED 50° ROAD; THE STAFF'S RECOMMENDATION IS, THEREFORE, BASED <br />ON CONTINGENCIES WHICH ARE NOT FORTHCOMING, <br />COMMISSIONER SCURLOCK LEFT THE MEETING AT 11:40 A.M. <br />ATTORNEY CIANFRONE INFORMED THE BOARD THAT THE ORDINANCE <br />IS CLEAR THAT THE APPLICATION MUST STATE THAT THERE ARE UNUSUAL <br />CIRCUMSTANCES INVOLVED, AND THE BOARD WOULD HAVE TO DECIDE WHETHER <br />THE DESIRE TO SUBDIVIDE INTO SEVEN 1/2 ACRE LOTS COMPRISES SUCH <br />CIRCUMSTANCES, <br />IN DISCUSSION, IT WAS NOTED THAT THE 1/2 ACRE LOTS ARE <br />NECESSARY IN ORDER TO HAVE INDIVIDUAL WELLS AND SEPTIC TANKS, AND <br />THE QUESTION OF WATER SUPPLY AROSE, <br />DAN RICHARDSON, SON—I'N—LAW OF MRS. HOPWOOD, ADDRESSED THE <br />BOARD, CONFIRMING THAT THIS IS BEAUTIFUL, NATURALLY VEGETATED <br />PROPERTY WITH A MEANDERING ROAD UP TO -.THE BEACH, WHICH HAS ALWAYS <br />INTENDED FOR FAMILY USE AND NOT FOR A FUTURE SUBDIVISION, MRS, HOPWOOD <br />WISHES TO KEEP THIS PROPERTY THE WAY IT IS, AND FEELS THE RECOMMENDED <br />PROPOSAL WOULD DOWNGRADE HER PROPERTY. <br />JOHN MCPHERSON SPOKE REPRESENTING PELICAN LANE PROPERTY <br />OWNERS AND STATED THAT THEY OPPOSE THE GRANTING OF THE VARIANCE WHICH <br />THEY FEEL WOULD OPEN A FLOOD GATE FOR SIMILAR PARCELS ON THE ISLAND. <br />HE FURTHER NOTED THAT AT A TIME WHEN THE COMMISSION IS INVOLVED IN A <br />CONTROVERSIAL LAND USE PLAN AND TRYING TO PROTECT THE BARRIER ISLAND <br />FROM BECOMING A CONCRETE JUNGLE, PASSAGE OF SUCH A VARIANCE WOULD <br />RAISE QUESTIONS, AND HE FELT IT WOULD LEAD TO STILL MORE LAWSUITS. <br />HE REQUESTED THAT THE BOARD LISTEN TO THE PEOPLE SO THEY WOULD NOT <br />HAVE TO RESORT TO LITIGATION. <br />CHAIRMAN LYONS DID NOT UNDERSTAND WHETHER THEY WERE OBJECTING <br />TO THE SUBDIVIDING OF THIS PARCEL OR TO THE ROAD. <br />w <br />a00K 47 PAGE 496 <br />
