ORDINANCE NO. 79-1 <br />AN AMENDMENT TO INDIAN RIVER COUNTY ORDINANCE 78-18 <br />EXTENDING FOR AN ADDITIONAL THREE MONTHS THE MORATORIUM <br />ON ISSUANCE OF NEW SEWER AND/OR WATER FRANCHISES OR THE <br />ENLARGEMENT OF ANY EXISTING SEWER OR WATER FRANCHISE AREAS <br />WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, pursuant to Chapter 59-1380, Laws of Florida, <br />has authority to issue, modify, amend and revoke Sewer and <br />Water Franchises within Indian River County, Florida; and <br />WHEREAS, the BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, has previously adopted Indian River County <br />Ordinance 78-18, which Ordinance became effective July 12, 1978; <br />and <br />WHEREAS, the basic purpose of Indian River County Ordinance <br />78-18 was to declare a moratorium enabling appropriate governmental <br />planners to evaluate the County sewer and water needs and to <br />prepare a general overall plan; and <br />WHEREAS, it appears .that an additional three (3) months will <br />be required to obtain the necessary engineering and geological <br />review of existing sewer and water reports and preparation of <br />new County studies; and <br />WHEREAS, the BOARD OF COUNTY COMMISSIONERS for Indian River <br />County determines that it is in the best interest of the County's <br />public health and welfare to extend the sewer and water moratorium <br />affecting issuance of new franchises or enlargement of existing <br />franchises for an additional three (3) month period of time; and <br />WHEREAS, it is anticipated that in addition to the necessary <br />studies, new rules and regulations affecting franchises will be <br />implemented by the Board prior to April 10, 1979; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COM- <br />MISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That Indian River <br />County Ordinance 78-18 is hereby amended by extending the moratorium <br />on the issuance of new sewer and/or water franchises or the <br />W <br />STATE OF FLORIDA <br />INDIAN RIVER COUNTY <br />THIS IS TO CERTIFY THAT THIS IS <br />A TRUE AND CORRECT COPY OF <br />THE ORIGINAL ON FILE IN THIS <br />OFFICE. <br />FREDA MIGHT, CLERK <br />13Y D.C. <br />DATE <br />
