(; INDIAN RIVER COUNTY ORDINANCE NO. 75-� <br />I I <br />i <br />i <br />An Ordinance to be entitled: <br />An Ordinance relating to set backs on each side of State <br />Road 60 from the West Boundary of the Main Canal to the <br />Interstate 95 Interchange; providing for building construction <br />i, set backs of at least seventy-five (751) feet from the right of <br />way line of State Road 60; providing penalties; and <br />providing an effective date. <br />I <br />I WHEREAS, the Board of County Commissioners of Indian River <br />i' <br />County recognizes that the opening of Interstate 95 will tend to attract a <br />corridor of auto -oriented enterprises along State Road 60 and this movement <br />should be carefully regulated in order to protect the locality's main traffic f <br />accessway to Interstate 95 to insure sound stabilized economic growth, and <br />f'. WHEREAS, a Master Plan for the orderly development of Indian i <br />j River County has not yet been adopted by Ordinance, and j <br />!i WHEREAS, rapid development of property on each side of State <br />Road 60 would frustrate the purposes of the Master Plan, i <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County: <br />Section 1. There is hereby established a seventy-five (751) foot <br />building construction set back on all real property fronting on State Road 60 <br />I from the West boundary line of the Main Canal to the Interstate 95 Interchange! <br />�! The required set back shall be measured from the road right of way line. ! <br />I <br />i; Section 2. Anyone who violates this Ordinance shall be guilty of a <br />is <br />I. inisdeameanor and upon conviction, shall be punished by a fine not exceeding <br />,i <br />Five Hundred Dollars ($500. 00) or by imprisonment in the County Jail not <br />I <br />I' <br />j: exceeding sixty (60) days or by both fine and imprisonment. Each day in <br />u <br />li <br />violation shall constitute a separate offense.
