He now proposed an <br />agreement with the Town whereby the plans we currently have <br />for the park would become part of the agreement, as well as <br />the rules, and the Town would agree there is going to be a <br />park there for 99 years and that is the way it would be run. <br />The Mayor of Indian River Shores has indicated he would <br />recommend signing such an agreement. <br />Commissioner Scurlock believed we can enter into an <br />.agreement that will guaranty the use of the park for a <br />public purpose and stated he would support entering into <br />such an agreement. <br />Commissioner Wodtke stated that he could not see any <br />benefit to County residents by allowing this annexation, but <br />he was very much in sympathy with the residents in Pebble <br />Beach Villas and those who wished to remain in the Town, <br />and, therefore, he was willing to change his position to <br />some extent. He preferred not to allow annexation of all of <br />the five acres, but rather just allow 50' or 75' to be <br />annexed, which would become a buffer zone, and have the <br />County retain the area to be utilized as a park. <br />Attorney Collins reminded the Board that the Statutes <br />say you cannot have a corridor connecting two pieces of <br />land; he felt if 500 of the 5 acres were to be annexed, it <br />would not create a corridor. <br />Commissioner Wodtke still favored allowing annexation <br />of no more than 50 or 751, noting that someone would have to <br />challenge such an annexation in court, and the county <br />certainly wouldn't. He had no problem with an agreement as <br />to working with Indian River Shores on the development of <br />the park, but wanted the park in control of the County. <br />Considerable discussion continued as to the time frame, <br />the Town's reaction depending on the action the County <br />takes, and the appropriate amount of land to be annexed. <br />
