INDIAN RIVER COUNTY ORDINANCE NO. 84- <br />AN ORDINANCE AMENDING ORDINANCE NO. 72-8, <br />SECTION 5, CONSTITUTING SECTION 24-5 OF THE <br />CODE OF LAWS AND ORDINANCES OF INDIAN RIVER <br />COUNTY; PROVIDING FOR THE ISSUANCE OF <br />TEMPORARY UTILITY PERMITS NOT EXCEEDING <br />18 MONTHS IN DURATION; SEVERABILITY; AND <br />EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT; <br />SECTION 1 <br />Indian River County Ordinance No. 72-8 constituting <br />Section 24-5 of the Code of Laws and Ordinances of Indian River <br />County is hereby amended to add the following paragraph; <br />The Utility Department may issue permits not exceeding <br />18 months in duration for temporary systems which have not been <br />issued a County franchise if the services are for specific <br />buildings that have made arrangements to receive permanent service <br />from the County system within the 18 -month period and the service <br />offered is not generally available to the public." <br />SECTION 2 <br />SEVERABILITY <br />If any provision of this Ordinance or the application <br />thereof to any person or circumstance is held invalid, it is the <br />legislative intent that the invalidity shall not affect other <br />provisions or applications of this Section which can be given in <br />effect without the invalid provision or application, and to this <br />end, the provisions of this Section are declared severable. <br />SECTION 3 <br />EFFECTIVE DATE <br />The provisions of this Ordinance shall become effective <br />upon receipt from the Secretary of State of the State of Florida <br />of official acknowledgment that this Ordinance has been filed with <br />the Department of State. <br />Approved and adopted by the Board of County <br />Commissioners of Indian River County, Florida, on this 19th day <br />of September 1984. <br />3ID <br />
