Attorney Byron Cooksey appeared representing Arthur <br />Wilson and informed the Board that his client will withdraw <br />the appeal and leave the property zoned C-lA. <br />Fred Briggs asked for an opportunity to be heard and <br />complained at length about lack of proper notification to <br />affected property owners. <br />Bros. were not notified. <br />He wished to know why Hobart <br />Mr. Briggs was informed that we have a copy of a <br />receipt of notice to Hobart -Bros. which was sent to Troy, <br />Ohio and signed by Artemus Johnson. It was explained that <br />there is a legal requirement that the notice be sent to the <br />address of the owners where they receive their tax bills. <br />Mr. Briggs understood what had happened to the <br />notification to Hobart Bros. but wished to know why people <br />who own property adjacent to the subject property were not <br />notified. <br />Bernard Paz , property owner at Hobart Landing, <br />confirmed that he was never notified on the initial <br />rezoning, and that there are three additional adjacent <br />property owners he knows of who also received no <br />notification. <br />Commissioner Scurlock felt we need to clarify our <br />procedures, and Attorney Collins stated that on a <br />withdrawal, you start all over again. On a continuance, you <br />announce to the public the date to which the hearing will be <br />continued. He felt if the adjacent property owners did not <br />receive a notice of today's meeting, there is a breakdown in <br />procedures. <br />Commissioner Wodtke requested that Senior Planner <br />Challacombe look into this matter and see whether there was <br />a breakdown in the notification. <br />Commissioner Scurlock questioned now this matter has <br />been withdrawn, whether it can be resubmitted without going <br />back to the Planning & Zoning Commission. <br />Attorney Collins stated that the applicant can come <br />back <br />for the R -2B zoning which <br />has been reviewed, <br />but <br />NOV 181991 <br />29 <br />"CON <br />48 <br />PAA X64 <br />
