Y, F, <br />INDIAN RIVER COUNTY ORDINANCE NO. 84- 43 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AMENDING ORDINANCE <br />NUMBER 84-18 PROVIDING FOR A METHOD OF BILLING <br />CUSTOMERS WHO ARE ON THE COUNTY SEWER SYSTEM WHICH <br />DO NOT RECEIVE WATER SERVICE, PROVIDING FOR PENALTIES, <br />REPEAL OF CONFLICTING PROVISIONS, INCORPORATION AND <br />CODE, SEVERABILITY AND EFFECTIVE DATE. <br />NOW THEREFORE BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT: <br />SECTION 1. <br />Indian River County Ordinance No. 84-18, Section 7 <br />rates and charges, Paragraph C. is hereby amended to add the <br />following language; <br />Residential customers who only receive sewer service <br />from Indian River County shall be charged the maximum sewer charge <br />(i.e. 12,000 gallons) for each E.R.U. <br />SECTION 2. <br />PENALTIES <br />Any person, firm or corporation or anyone acting in <br />behalf thereof who shall violate or fail to comply with any of the <br />provisions of this article shall, upon conviction, be punished by <br />a fine not to exceed five hundred dollars ($500.00). The Board of <br />County Commissioners may enforce the provisions of this article <br />by seeking injunctive relief or any other remedies provided by <br />law. <br />SECTION 3. <br />REPEAL OF CONFLICTING PROVISIONS <br />All previous ordinances, resolutions, or motions of the <br />Board of County Commissioners of Indian River County, Florida <br />which conflict with the provisions of this ordinance are hereby <br />repealed to the extent of such conflict. All Special Acts of the <br />legislature applying only to the unincorporated portion of Indian <br />River County and which conflict with the provisions of this <br />ordinance are hereby repealed to the extent of such conflict. <br />SECTION 4. <br />INCORPORATION AND CODE <br />The provisions of this ordinance shall be incorporated <br />into the County Code and word "ordinance" may be changed to <br />-1- <br />
