SmeadSoft Reprint Date: Monday, August 12, 2013 - <br />24 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA AMENDING SECTION <br />p24(b)(4); .GENERAL PARKING STANDARDS,.OF APPENDIX A OF THE CODE OF <br />LAWS AND ORDINANCES OF INDIAN RIVER COUNTY, FLORIDA, KNOWN AS THE <br />ZONING CODE: PROVIDING FOR THE MODIFICATION OF CERTAIN WHEELSTOP <br />AND CURBING REQUIREMENTS; AND PROVIDING FOR REPEAL OF CONFLICTING <br />PROVISIONS, CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />NOW THEREFORE, be it.ordained by the Board of County Commissioners <br />of-Indian—,River.-Counter Florida that. <br />SECTION 1 <br />Section 24(b)(4) be hereby amended as follows: <br />" aces shall be equipped with tire stops <br />permanently affixed to the surface except when -six-inch <br />curbing or the equivalent is installed, with thefollow <br />exceptions: <br />Upon request by a site plan applicant, the public works <br />and..community development directors.may waive the wheel <br />stop curbing requirement for certain parking spaces <br />upon a determination that: <br />a. the waiver would not allow vehicles to encroach <br />upon -landscape --or estrian—areas (such_ -areas_ <br />shall be protected by wheelstops, curbing, or the <br />equivalent); <br />b. the waiver would not allow vehicles to abut or <br />'head into' one another in an fashion other than <br />bumper to bumper [any. bumer to fender or side) <br />parking,_con t i urations shall require wheelstops, <br />curbing, or the equivalent;] <br />C. the waiver would not apply to any space "heading <br />into" another space that requires a wheel stop, <br />curbing, or other equivalent; and <br />d the waiver would not apply to spaces accessed from <br />A—*x7eww is that qerup as ulation driveways which <br />channel traffic around' or through the site or <br />parking lot area. <br />e the site plan parking area and traffic circulation <br />design prdvide circulation driveways, as needed, to <br />adequately channelize traffic flow. <br />Conditions including but not limited to driveway curbing, signage <br />an or avemen mirkings, or periodic placement of barrier's or <br />increased protected landscaped areas that are deli ned to romote <br />good traffic -circulation may -be -attached to any waiver granted. <br />SECTION 2 <br />REPEAL OF CONFLICTING PROVISIONS <br />All previous ordinances, resolutions, or motions of the Board <br />of County. Commissioners of Indian River County, Florida which <br />conflict with the provisions of this ordinance are hereby repealed <br />to. the extent o such con lic . peci��Act�of�he tegisla� <br />ture applying only to the unincorporated portion of Indian River <br />County and which conflict with the provisions of this ordinance <br />are hereby repealed to the extent of such conflict. <br />SECTION 3 <br />CODIFICATION . <br />The .provisions of this ordinance shall be incorporated into <br />the County Code and the word "ordinance" may be changed to <br />Coding: Words in type are deletions from existing <br />law.
