"The County Commission shall at least fifteen (15) days <br />prior to the public hearing for rezoning, excluding <br />Sundays and legal holidays, publish notice of intent to <br />consider the rezoning in+a newspaper of general circu- <br />lation within the county." <br />This established rezoning procedure has worked well to provide <br />sufficient notice and time to all parties wishing to give testi- <br />mony at a public hearing. The complexity of the issues presented <br />in the Audubon Society's appeal make a minimum 15 day notice, <br />prior to the public hearing an equitable and appropriate time <br />frame for scheduling. <br />B) Set a hearing date prior -to -February 3, 1982. ' <br />Dear Chairman Lyons and iiembers of the Commission,.: <br />Whereas, the Planning Department, in determining that the CounEv <br />Commission should review aspects of this site plan proposal and render a <br />deci^ion prior to project consideration by the Planning and Zon i.ng, <br />Commission, was not prepared to present its findings and rebuttal regarding <br />the yacht club situ plan. In effect, the Planning and Zoning Commission <br />rendered its opinion wi.thout hearing and .considerinh the Planniii Daparti;.c..nt's <br />recommendations. <br />And, whereas, 010 i7 iolog ic•al assess -.hent prepared by the Florida <br />Game and Fresh water Fish Com:,?ission at the pers.)nal request of the <br />Planning Department's Director was not circulated to the Planning and <br />Zoning Commission before the meeting of: December 1.7.
