DRAWER E <br />WEST PALM BEACH, FLORITjA 33402 <br />(3051 659-3000 <br />January 4, 1982 <br />By Hand <br />Although we haven't been officially notified, we have been <br />advised by the Planning Department that the Audubon Society <br />has filed an 11lppeal of the decision of the Zoning Board <br />re approval of the Site Plan of the River Bend Yacht Club. <br />As I understand it, the County CoIimission has placed this <br />matter on the agenda of their January 6, 1982 meeting with <br />a view to scheduling a public hearing on the Appeal pursuant <br />to the applicable provisions of the ordinance. <br />It is Florida Land Company's position that the Audubon <br />Society totally lacks standing to appeal this matter and I <br />would call your attention to the following authorities: <br />(A.) See Boucher v Novotny, 102 So. 2d 132 (Sup. Ct. 1958) <br />for a basic statement of the standing requirements in <br />Florida, i.e. to be an "aggrieved party" (or a "party with <br />an aggrieved interest") there must be a showing of special <br />damages peculiar to the appellant differing in kind, as <br />distinguished from damages differing in degree, suffered <br />by the community as a whole (a copy of case enclosed). <br />(B.)
