Y <br />INDIAN RIVER COUNTY ORDINANCE NO. 85- 103 <br />AN ORDINANCE OF INDIAN RIVER COUN'T'Y, <br />FLORIDA, CREATING THE 131tEEZY VILLAGE <br />MOBILE HOME PARK RECREATION DISTItICT, <br />PURSUANT TO CHAPTER 418, PART ll, FLORIDA <br />STATUTES; PROVIDING A CHARTER THE1tl?FOR; <br />PROVIDING AN EFFECTIVE DA'L'E. <br />WHEREAS, Chapter 418, Florida Statutes, authorizes a <br />county to create_ mobile home park recreation districts by ordinance <br />with boundaries to be that of the mobile home park in question, for <br />the purposes enumerated in Chapter 418, and, in particular, for the <br />purpose of levying and assessing a special assessment against each <br />mobile home parcel within the district to raise funds to rrequir,r <br />and imprwe streets and lights, recreation facilitic,, and ether <br />eoiumon areas of all types, including real property and personal <br />pr„perty; and <br />WHEREAS, certain residents of lireeiv %!Have !lobile <br />'j-- Pirk have• petitioned the County to oro -at- s,Ych a ri.,hil, hon.• <br />:-K. rerrentinn district; and <br />WHEREAS, the t'ounty Hud, `i;a! such 1 gioro Y v, uw <br />h- in the public interest; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD <br />OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />that: <br />SLCfION 1. CREATION AND CHARTER OF ulsl'ItIc1' <br />'Chis ordintinee shall create and serve as the Charter for <br />the Nreezy wringe mobile Ifome Park Recreation Dislrici. "Che <br />boundaries of the district shall he as shown on Exhibit "A" <br />attached to this ordinance. <br />SECTION 2. NO REFERENDUM HLOUIRED <br />The Hoard of County Commissioners finds that a majority <br />of the electors of the proposed district has signed n petition <br />requesting that the County create the mobile home park recreation <br />district, and, therefore, pursuant to 3418.30, Florida Statutes, no <br />referendum shall be required to create the district. 'rhe petition <br />shall be kept on file at the Clerk's Office. <br />SEC'T'ION 3. GOVERNING BODY OF DIS'T'RICT <br />The governing body of the district shall consist of a <br />nine -member board of trustees elected pursuant to 3418.302, Florida <br />Statutes.
