Attorney Brandenburg stated that he would look <br />into that possibility but felt it was very remote. He <br />doubted that they would depart from their standard form for <br />the County. He added that the County had agreed to this in <br />1978 and now they were formalizing the agreement. The <br />Attorney stated that if the County would not agree, the FEC <br />could stop the County from crossing over their railroad <br />tracks. He warned that the County would also risk the <br />chance of losing their funding of the 5th and 6th cent gas <br />tax. <br />Mr. Thomas reviewed the financial aspects of this <br />matter with the Board. <br />Motion was made by Commissioner'Lyons, seconded by <br />Commissioner Wodtke, for the Board to accept the <br />recommendation of the Administrator to adopt and execute the <br />agreements and resolutions as follows: Resolution 82-26 for <br />Glendale Road at the FEC Railroad; Resolution 82-27 for <br />Roseland Road at the FEC Railroad; and Resolution 82-28 for <br />South Gifford Road at the FEC Railroad; and to authorize the <br />signature of the Chairman; and that the County pay <br />$11,290.08 for improvements to the Oslo Road Crossing; that <br />the funding of $35,000 be transferred from <br />#111-199-541-99.91 to account #111-214-541-34.46. <br />Commissioner Fletcher felt it should be stipulated <br />that the County be notified of any work being done at the <br />railroad crossings. <br />Attorney Brandenburg advised that the FEC Railroad <br />was communicating with the Department of Transportation, and <br />that he would write to them asking that the County be <br />notified of any work initiated by the FEC. <br />The Chairman called for the question.
