PALMER, JOHN V. LITTLE and THOMAS R. NASON, <br />herewith stipulate for dismissal of this action in which no <br />�,property has been seized and no property is in the custody of the <br />i <br />I!Court, and agree that this action shall be dismissed upon the <br />i� <br />!"filing of this stipulation, signed by all parties. The dismissal <br />I <br />its with prejudice as to all matters except for the items set forth; <br />On this stipulation. In addition to filing this stipulation of <br />jdismissal in this action, which shall operate as a dismissal <br />without order of Court, the parties agree that this stipulation <br />shall be recorded in the office of the Clerk of the Circuit Court <br />of Indian River County, Florida. <br />The matters agreed upon between the parties as a basis for <br />this stipulation of dismissal and the matters which this dismissal <br />shall be without prejudice are as follows: <br />1. The City will promptlytpa,y to the Moorings the sum of <br />One Hundred Twenty-five Thousand Dollars ($125,000.00).
