RD FT OF DECEMBER 17, 198WNNING & ZONING C0:1ZISSPN44■, ETIING <br />Mrs. Goetzfried said a ccmplete site plan application had <br />been submitted, adequate provisions had been made for drainage, parking <br />landscaping, and staff recommended approval. <br />Mr. Parent moved to approve the JAMES McKEEVER site plan; <br />Mrs. Bowman seconded and the Board unanimously approved. <br />ITEM #9, RIVER BEND YACHT CLUB, was presented to the <br />Board by Mrs. Goetzfried. She said this original application was <br />submitted in September of 1981. Mr. Robert Cairns, Trustee,.and Mr. <br />James Newlon, Agent, propose to construct a private 96 slip yacht <br />basin on approximately 8.1 acres of property located 1/2 mile south of <br />Wabasso Beach Road on the east side o -f_ Jungle Trail. She said they <br />proposed to dredge a 5.46 acre basin, along with a 40 foot channel <br />through Jungle Trail (which would connect the Intra -coastal waterway_ <br />with this basin). This also includes a drawbridge, an offshoot park-, <br />ing area, and provisions for 96 boats. <br />Mrs. Goetzfried said at this time, the Planning staff <br />recommends the decision on this site plan be deferred as far as policy' <br />goes on the drawbridge and provisions for an alternate road (beings <br />this is a road that has not been dedicated to Indian River County by <br />the applicant, but through prescriptive rights and maintenance, <br />this road is Indian River County's which the applicants do not agree <br />with. They have made provisions for a limited -easement -access road <br />that when the bridge was up or being repaired, the route -road would <br />be opened. She went on to say the road would be Florida Land's <br />ownership and they would have control over the use of 'this road. <br />Mrs. Goetzfried said the Planning staff recommended <br />the Commissioner's decision be postponed at this time; simply because <br />policy has not been established on the use of a drawbridge on public <br />road and is it appropriate for the County to abandon its rights to a <br />portion of this road and to the title of:what type of easement or <br />full dedication would be granted for the route road, and until these <br />pol cies.are set, the Planning Department felt it would premature for <br />the staff to make a recommendation at this time. <br />Mr. Brandenburg said one possible point of correction <br />with the statement given by staff was he was not sure the representa- <br />tives, of the applicant have denied rights and ownership of that road <br />at this point. <br />The Chairman stated the County Commission had made it <br />JAN 2 7 1982-11- <br />EOOK S PAGE 691 <br />
