Attorney Henderson believed that by accepting all this
<br />into the record, the Commission skipped over the standing
<br />issue, which is that Florida Land Company maintains that the
<br />Audubon Society lacks standing to be heard before this
<br />Commission on the basis of an administrative appeal. He
<br />requested that his letter of January 4, 1982, which was sent
<br />to Attorney Brandenburg and later to each of the
<br />Commissioners, be placed in the record.
<br />On Motion by Commissioner Lyons, seconded by
<br />Commissioner Fletcher, the Board unanimously made Attorney
<br />Henderson's letter of January 4, 1982, to Attorney
<br />Brandenburg a part of the record, as follows:

<br />Although we haven't been officially notified, we have been
<br />advised by the Planning Department that the Audubon Society
<br />has filed an Appeal'of the decision of the Zoning Board
<br />re approval of the Site Plan of the River Bend Yacht Club.
<br />As I understand it, the County Commission has placed this
<br />matter on the -agenda of their January 6, 1982 meeting with
<br />a view to scheduling a public hearing on the Appeal pursuant
<br />to the applicable provisions of the Ordinance.
<br />It is Florida Land Company's position that the Audubon
<br />Society totally lacks standing to appeal this matter and I
<br />would call your attention to the following authorities:
