P,r1(19 48 PnF 805 <br />FEB 21982 <br />1) Approximately 4000 acres owned by the Ro-moi Coporation (J. Bradley, agent) <br />2) i�pproxirately 4000 acres owned by the Corrigan Family (Pat Corrigan, anent) <br />3) Vero Lake Estates Subdivision, approximately 2000 acres, the drainage <br />of which is maintained by Indian River County. <br />In order to acccmplish clearing of the Canal, Mr. Marvin Carter, Carter and <br />Assoc., representin; concerned property owners, has approached. the County in <br />finding a solution as to how to pay for the clearing of the canal. Th.e County <br />Administrator and County Public Works Director held a series of meetings to resolve <br />the issue with Mr. Pat Corrigan, Mr. T. Bradley, and Marvin Carter. <br />ALTEkNLUIVFS AND ANALYSIS <br />At a meeting held October of 1981, the affected property o1•.ners decided <br />to first define the cost for the clearinb work. Six companies normally engaged <br />in clearing work were contacted and John Trodglen and Company submitted the <br />low bid price of $13,690. <br />At a meeting held January 8, 1982, Mr. Corrigan, Mr. Bradley and the <br />County Administrator mutually agreed that since the forementioned respective <br />parties o1,'n 4,000 acres, 4,000 acres and 2,000 acres, the Corrigans and Ro-Ed <br />Corporation should each share 400 of the cost ($5,476. each) and the County should <br />share 200 of the cost ($2,738.). The County's benefit would include improved <br />drainage for the Vero Lake Estates Subdivision and protection from erosion along <br />CR 510. <br />When the Board of County Commissioners considered this matter during the <br />January 20, 1982 meeting, it was requested that a Sebastian River Water Manage- <br />ment District representative be present to explain the following: <br />1) Why doesn't the District clean this canal? <br />2) If the County, Ro-Ed Corp., and the Corrigans want to assume this main- <br />tenance, will the District grant the appropriate easement to the above <br />parties for present and future maintenance. <br />In discussing these items with Mr. Tom Barnes of the Sebastian River Water <br />Management District, he has stated that the District wishes to retain control <br />Of the easement to maintain the berm in this easement which borders the west <br />boundary of the District. However, he felt that the District would work out <br />with the above three (3) parties an easement agreement by which the maintenance <br />of the canal may be performed both now and in the future. A court order- issued <br />in the 1960's does grant the owners of the 10,000 acres in the watershed area <br />the right to drainage via the canal. <br />RECONi �IENTDaTIONS AND RANDING <br />Based upon the above meetings it is recommended that: <br />1) The County proceed to share in the $2,738. cost for clearing Canal <br />"D". Funding to be from account #004-214-541-35.39 Road and Bridge <br />Materials Account, (unencumbered balance 11-31-81 is $546,779.). <br />2) The County Administrator be authorized to participate in i.orking <br />out an easement agreement between the Sebastian River Water Manage- <br />ment District and the County, Ro-Ed Corp., and Pat Corrigan for the <br />right to maintain the canal in the future. <br />
