INDIAN RIVER COUNTY ORDINANCE NO. 80-1 <br />AN ORDINANCE RELATING TO SET BACKS ON EACH SIDE <br />OF STATE ROAD 60 FROM THE WEST BOUNDARY OF THE <br />MAIN CANAL TO INTERSTATE 95 INTERCHANGE; PROVIDING <br />FOR BUILDING CONSTRUCTION SET BACKS OF AT LEAST <br />SEVENTY-FIVE (75') FEET FROM THE RIGHT OF WAY LINE <br />OF STATE ROAD 60; PROVIDING FOR PENALTIES: AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners of. Indian River <br />County recognizes that the opening of Interstate 95 into St. <br />Lucie County will tend to attract a corridor of auto -oriented <br />enterprises along State Road 60 and this movement should be <br />carefully regulated in order to protect the locality's main <br />traffic accessway to Interstate 95 to insure sound stablized <br />economic growth; and <br />WHEREAS, Indian River County is attempting to comply with <br />the State Comprehensive Land Use Statutes for the purposes of <br />insuring orderly development within Indian River County; and <br />WHEREAS, a rapid development of property on either side of <br />State Road 60 would frustrate the purposes of orderly planned <br />growth within the County; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That: <br />Section 1. There is hereby established a seventy-five <br />(75') foot building construction set back on all real property <br />fronting on State Road 60 from the West boundary line of the <br />Main Canal to the Interstate 95 Interchange. The required <br />set back shall be measured from the road right of way line. <br />Section 2. Anyone who violates this Ordinance shall be <br />quilty of a misdemeanor and upon conviction, shall be punished <br />by a fine not exceeding Five Hundred Dollars ($500.00) or by <br />imprisonment in the County Jail not exceeding sixty (60) days <br />or by both fine and imprisonment.
