ORD1:w= no. 80-29 <br />)4V ORDINANCE PROVIDING FOR PENALTIES FOR VIOLATIOPIS OF <br />(IiAP i ER 3, INDIXN RIVER (7JU`lPi' CODE OF ORDI`IANCES , 14Z D <br />REPEALING SECTIONS 3-8, 3-27, 3-36, (d), INDIAN RIVER <br />OOUDITY CODE OF ORDINANCES. <br />WHEREAS the Board of County Commissioners is authorized to provide <br />penalties for violations of County Ordinances under authority of Florida <br />Statutes 125.69; and, <br />WHEREAS it is the intention of the Board of County r..or :aissioners of <br />Indian River County to enact a uniform penalties provision for violations of <br />Chapter 3 of the Indian River County Code of Ordinances, and to repeal existing <br />penalty provisions within said Chapter. <br />NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COU -WY COi--ZUSSIONF:RS OF <br />INDIAN RIVER COUNTY FI GRID A: <br />That Chapter 3, Indian River County Code of Ordinances, entitled <br />Animals and Foal, is hereby amended by creating a penalties provision to read <br />and provide as follows: <br />SECTICiNI - Violations and Penalties <br />Any person, firm or corporation or anyone acting in behalf thereof, <br />who shall violate or fail to comply with any of the provisions of this Chapter, <br />as amended, shall upon conviction be punished by a fine not to exceed $500.00. <br />The Board of County Cam-dssioners may enforce provisions of this Chapter by <br />seeking injunctive relief or any other remedies provided by law. <br />SECTION - Savings Clause <br />Any word, phrase, clause, section or subsection of this Ordinance <br />is for any reason held unconstitutional or invalid, the invalidity thereof shall <br />not effect the validity of any ranaining portions of this Ordinance. <br />SECTION - Repeal of Conflicting Ordinances <br />That Sections 3-8, 3-27, 3-36, (d), all being a part of Chapter 3 of <br />the Indian River County Code of Ordinances and all other Ordinances or parts of <br />Ordinances, and all Resolutions or parts of Resolutions, in conflict herewith, be, <br />and the same are, hereby repealed to the extent of such conflict. <br />This Ordinance shall take effect June 9, 1980. <br />STATE OF FLORIDA <br />INDIAN RIVER COUNTY <br />THIS IS TO CERTIFY THAT THIS IS <br />A TRUE AND CORRECT COPY OF <br />THE ORIGINAL ON FILE IN THIS <br />OFFICE. <br />FREDA WRIGHT, CLERK <br />BY .C. <br />1)4/a k "%'AD <br />
