M � � <br />INDIAN RIVER COUNTY ORDINANCE #84-47 <br />AN ORDINANCE TO BE KNOWN AS THE INDIAN RIVER COUNTY <br />LANDSCAPE ORDINANCE; PROVIDING FOR A SHORT TITLE; DECLARING <br />PURPOSE AND INTENT; PROVIDING FOR APPLICABILITY; PROVIDING FOR <br />DEFINITIONS; PROVIDING FOR PLANT INSTALLATION, MAINTENANCE, AND <br />MATERIALS; PROVIDING CREDIT FOR EXISTING PLANT MATERIAL; <br />PROVIDING FOR REQUIRED LANDSCAPING IN OFF-STREET PARKING AND <br />OTHER VEHICULAR USE AREAS PROVIDING FOR REQUIRED LANDSCAPING IN <br />NON -VEHICULAR OPEN SPACE AREAS; PROVIDING FOR LANDSCAPE PLAN <br />APPROVAL AND ISSUANCE OF A CERTIFICATE OF OCCUPANCY; PROVIDING <br />FOR VARIANCES AND ADMINISTRATIVE APPEALS; PROVIDING FOR EN- <br />FORCEMENT, VIOLATIONS, PENALTIES, AND OTHER LEGAL ADMINISTRA- <br />TIVE REMEDIES; PROVIDING FOR THE REPEAL OF CONFLICTING PRO- <br />VISIONS; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND <br />ORDINANCES OF INDIAN RIVER COUNTY; PROVIDING FOR SEVERABILITY; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA: <br />SECTION 1. SHORT TITLE. <br />This ordinance shall be known and may be cited as the <br />Indian River County Landscape Ordinance. <br />SECTION 2. DECLARATION OF PURPOSE AND INTENT. <br />It is the purpose and intent of this ordinance to <br />improve the appearance of certain setback and yard areas <br />including off-street vehicular parking and non -vehicular open <br />space areas in Indian River County; to protect and preserve the <br />appearance, character and value of the surrounding neighbor- <br />hoods and thereby promote the general welfare by providing for <br />installation and maintenance of landscaping for screening and <br />elimination of visual pollution, since the County Commission <br />finds that the unique characteristics and qualities of Indian <br />River County justify regulations to perpetuate the appeal of <br />its natural visual pollution free environment. <br />SECTION 3. APPLICABILITY. <br />This ordinance shall be applicable to all land lying <br />in the unincorporated area of Indian River County, Florida. <br />SECTION 4. DEFINITIONS. <br />1. Accessway: A paved area intended to provide <br />ingress and egress of vehicular traffic from a public or <br />private right-of-way to an off-street parking area. <br />1 <br />
