operation thereunder. The licensee shall defend in the name of <br />the County and shall pay all expenses incurred by the County in <br />defending itself with regard to all damages and penalties the <br />County may legally be required to pay as a result of the license <br />granted hereunder. These damages or penalties shall include, but <br />shall not be limited to, damages arising out of copyright in- <br />fringement and all other damages arising out of the installation, <br />operation or maintenance of the CATV system authorized herein, <br />whether or not any act or omission complained of is authorized, <br />allowed or prohibited by this Ordinance. The expense shall <br />include all incidental expenses including attorney fees and shall <br />also include a reasonable value of any services rendered by the <br />Office of the County Attorney. <br />B. The licensee shall maintain and pay for liability <br />insurance, insuring the County and the licensee against all claims <br />for damages charged against the County or the license, resulting <br />from the installation, development, maintenance, operation or <br />expansion of the CATV system authorized by this Ordinance. The <br />licensee shall maintain such insurance in the name of Indian River <br />County throughout the duration of the license in the minimum <br />amounts of: <br />1. $250,000 for bodily injury or death to any one <br />Berson with an aggregate limit for any one occurrence of $500,000 <br />for bodily injury or death. <br />2. $250,000 for prooerty damage resulting from any one <br />accident. <br />3. Umbrella liability of $2,000,000 for all types <br />liability. <br />4. $500,000 for all other types of liability. <br />5. Contractural liability insurance covering all <br />liability arising out of the terms of the license agreement. <br />6. Worker's Compensation Insurance as required by <br />Chapter 440, Florida Statutes. <br />7. Automobile Liability Insurance covering all owned, <br />non -owned and hired vehicles used in connection with the <br />licensee's work in amounts as indicated in 1 and 2 above. <br />-11- <br />
