before the Board of County Commissioners at their regular meeting <br />under the County Utility Division's items on the agenda and brought <br />to the attention of the Board. <br />E. The Board of County Commissioners, after having been <br />presented with the investigative report and recommendation of the <br />County Utility Department, shall determine whether to set the <br />matter for public hearing pursuant to the revocation or suspension <br />provisions as hereinafter recited, refer the matter to the County <br />Utility Department or to any other County Department for further <br />study and recommendation or to decline to take any other further <br />action. <br />ARTICLE V <br />SECTION 21. PERMIT REQUIRED <br />Upon the granting of a license by the Commission, the <br />licensee shall make application to the County Engineering <br />Department for construction permits for all work to be performed in <br />County rights of way or easements. <br />A. In the event that the installation does not meet <br />County standards or causes damages to the public right of way, <br />including pavement, curbing, sidewalk, drainage facilities, swales, <br />parkways, grassed areas, traffic signs or other public facilities <br />within the public way, the County shall have the right to require <br />the repairs to be made subject to revocation of license by the <br />Board of County Commissioners and/or call in the performance bond <br />required by Section 10 (c) if these repairs are not accomplished in <br />accordance with County standards. <br />SECTION 22. RELOCATION OF FACILITIES <br />A. Any CATV facilities heretofore or hereafter placed <br />upon, under or over any public way that is found by the Commission <br />or by the County Utility Division to be unreasonably interfering in <br />any way with the convenience, safety and continuous use and <br />maintenance of such public way shall, upon thirty (30) days written <br />notice to the licensee be removed or relocated by the licensee at <br />his own expense. <br />B. If at any time during the period of a license the <br />County shall elect to alter, change, expand, improve, repair or <br />-17- <br />
