Not to adopt this ordinance would jepordize the health, safety <br />and welfare of the residents of Indian River County and those <br />visitors traveling within the Indian River County Community. <br />It would also necessitate aquisition of right-of-way for <br />a service road on both sides of State Highway 60 at a future <br />date thus causing a very significant cost burden ori the <br />County and its residents. <br />RECOMMENDATIONS <br />It is recommended that the Board of County Commissioners adopt <br />the ordinance and authorize Staff to take appropriate action. <br />Attorney Brandenburg reported that this ordinance <br />replaces one that has been on the books for some time and it <br />reinstates the setback with only some minor changes, i.e., <br />lv <br />ari <br />noances shall be granted, and, rather than expiring <br />yearly, the ordinance will continue in effect until the <br />Board modifies it or goes with some other thoroughfare plan. <br />He did not feel this would present any more legal hurdles <br />than the way it was set up in the past. <br />The Chairman asked if anyone present wished to be <br />heard. <br />Herschel Auxier, owner of property on Route 60, which <br />has been all subdivided and sold except for the front area, <br />expressed concern as to how this will affect the use of his <br />remaining property. He noted there is a large ditch on the <br />south side of Route 60, and if you take away 75', that will <br />include that ditch. <br />Zoning Director Dewey Walker felt that the ditch will <br />probably serve as a median strip between the service road <br />that is supposed to go in there and the main highway, and <br />it was further explained that the 75' is merely a setback <br />for building construction, and it can be used for parking, <br />landscaping, signs, etc.,- small items that can be removed. <br />Commissioner Wodtke confirmed that the right-of-way <br />line is south of the ditch and assured Mr. Auxier that the <br />32 <br />
