FEB 171982 <br />?OK 4 <br />INDIAN RIVER COUNTY ORDINANCE NO. 82-4 <br />AN ORDINANCE RELATING TO SET BACKS ON EACH SIDE OF <br />STATE ROAD 60 FROM THE WEST BOUNDARY OF THE MAIN <br />CANAL TO INTERSTATE 95 INTERCHANGE: PROVIDING FOR <br />BUILDING CONSTRUCTION SET BACKS OF AT LEAST SEVENTY- <br />FIVE (75') FEET FROM THE RIGHT OF WAY LINE OF <br />STATE ROAD 60; PROVIDING FOR PENALTIES: AND PRO- <br />VIDING FOR AN EFFECTIVE DATE. <br />PA:; 863 <br />WHEREAS, the Board of County Commissioners of Indian <br />River County recognizes that the opening of Interstate 95 into St. <br />Lucie County will tend to attract a corridor of auto -oriented <br />enterprises along State Road 60 and this movement should be <br />carefully regulated in order to protect the locality's main <br />traffic accessway to Interstate 95 to insure sound stabilized <br />economic growth; and <br />WHEREAS, Indian River County is attempting to comply <br />with the State Comprehensive Land Use Statutes for the purposes of <br />insuring orderly development within Indian River County; and <br />WHEREAS, a rapid development of property on either side <br />of State Road 60 would frustrate the purposes of orderly planned <br />growth within the County; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That: <br />Section 1. There is hereby established a seventy-five <br />(75') foot building construction set back on all real property <br />fronting on State Road 60 from the West boundary line of the Main <br />Canal to the Interstate 95 Interchange. The required set back <br />shall be measured from the road right of way line. The Board of <br />Adjustments shall not have the authority to grant variances from <br />this Ordinance. <br />Section 2. Anyone who violates this Ordinance shall, <br />upon conviction, be punished by a fine not exceeding Five Hundred <br />Dollars ($500.00)' or by imprisonment in the County Jail not <br />exceeding sixty (60) days or by both fine and imprisonment. Each <br />day in violation shall constitute a separate offence. The Board <br />of County Commissioners may bring suit to restrain, enjoin or <br />otherwise prevent violation of this Ordinance in the Circuit Court <br />of Indian River County, Florida. <br />
