1/10/89(ORD)Legal)Vk <br />ORDINANCE NO. 89- 6 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORI_DA,_ CALL__I_NG FOR A COUNTY -WIDE <br />REFERENDUM ON THE LEVY OF A ONE -CENT <br />($.01) DISCRETIONARY SALES SURTAX FOR A <br />PERIOD OF FIFTEEN (15) YEARS IN INDIAN <br />RIVER COUNTY, FLORIDA; SETTING A DATE <br />FOR SUCH REFERENDUM; SETTING FORTH THE <br />WORDING FOR THE BALLOT; DEFINING THE <br />ALLOWED USES OF SAID TAX, IF APPROVED; <br />SETTING FORTH THE METHOD OF ALLOCATING <br />THE—PROCEEDS-OF—SAH) TAX; AND—PROW DING <br />AN EFFECTIVE DATE OF SAID TAX, IF <br />APPROVED, ALL AS PROVIDED FOR IN <br />§212.055(2), F.S. <br />WHEREAS, the 1987 Florida Legislature passed §212.055, <br />Florida Statutes, authorizing a county discretionary sales <br />surtax of up to one cent ($.01) for a period of up to <br />fifteen (15) years, if approved by the voters of a county, <br />for the funding of infrastructure of the county and <br />municipalities within the county; and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County has determined that the enactment of an <br />ordinance adopting such a tax if approved by the voters is <br />in the public interest and would allow for the <br />infrastructure improvements as fisted in the baflot language <br />proposed in this ordinance; and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County has agreed to choose the projects and their <br />pr iw Lty�_only a fter—an—adver_tised—p_ubJ is _hearing, _ at wh_i_ch <br />time members of the public may.attend and give comment, <br />NOW, THEREFORE, BE IT ORDAINED BY INDIAN RIVER COUNTY, <br />acting through its BOARD OF COUNTY COMMISSIONERS, that: <br />SECTION 1. REFERENDUM <br />A referendum shall be held on Tuesday, March 14, 1989, <br />for voter approval of a one -cent ($.01) discretionary sales <br />surtax for a period of fifteen (15) years in Indian River <br />County, Florida. <br />SECTION 2.
