ORDINANCE NO. 85-26 <br />WHEREAS, the Board of County Commissioners of Indian•River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property and pursuant thereto <br />held a public hearing in relation thereto, at which parties in <br />interest and citizens were heard; NOW, THEREFORE, <br />BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the Zoning Ordinance of <br />Indian River County, Florida, and the accompanying Zoning Map, <br />be amended as follows: <br />1. That the Zoning Map be changed in order that the <br />following described property situated in <br />Indian River County, Florida, to -wit: <br />The East 5 acres of the S'h of the Nz of the SE; of the <br />NE4; a portion of the south h of the SEa of the NE; all <br />lying east of U.S. Highway #1 and being in Section 13, <br />Township 33S, Range 39E all being more particularly <br />described as follows: <br />Commencing at the SE corner of the NE; of Section 13, <br />Township 33S, Range 39E; thence north 0047128" East along <br />range line a distance of 995.84' to the NE corner of said <br />east 5 acres; thence north 89016122" west along north line <br />of said east 5 acres a distance of 150' to the west <br />right-of-way line of proposed Indian River Boulevard and <br />also being the true Point of Beginning; thence south <br />0047128" west along said proposed west right-of-way a <br />distance of 362.63' to the point of tangency; thence along <br />a curve in a southwesterly direction having a radius of <br />497.961, a delta of 83024157" and an arc length of 724.97' <br />to a point on the east property line of Zippy Mart Inc.; <br />thence north 15045148" west along said east property line <br />a distance of 203.07' to the NE corner of Zippy Mart Inc.; <br />thence north 89019'38" west along said north property line <br />a distance of 87.021; thence north 0041108" east a <br />distance of 150' to a point; thence north 89°17102" west a <br />distance of 252.13' to the east right-of-way line of U.S. <br />Highway #1; thence north 27°59110" west along said east <br />right-of-way line a distance of 205.84' to the NW corner <br />of the South h of the SEa of the NE; lying east of U.S. <br />Highway #1; thence along north line of said S'h a distance <br />of 430.631to the SW corner of said East 5 acres; thence <br />north 0043121" east along west line of said East 5 acres a <br />distance of 331.37' to the NW corner of said East 5 acres; <br />thence south 89016122" east along north line of said East <br />5 acres a distance of 507.01' back to said true Point of <br />Beginning. <br />LESS AND EXCEPT, the west 600' running parallel to the <br />east right-of-way of U.S. Highway #1. All lands now lying <br />and being in Indian River County, Florida. <br />Be changed from R-2, Multiple -Family District, to C-1, <br />Commercial District. <br />
