MAR 17:1982 Mak . <br />REQUEST FOR EXTENSION OF TRANSITION PERIOD FOR WILMOTH <br />APPEAL OF SITE PLAN DENIAL <br />Mr. Ragsdale reviewed the following memo: <br />TO: The Honorable Board of DATE: March 8, 1982 FILE: IRC -8I -SP -160 <br />County Commissioners <br />SUBJECT: FRANK & SUSAN WILMOTH' S APPEAL <br />OF SITE PLAN DE14IAL AND REQUEST <br />FOR A 60 DAY EXTENSION OF THE <br />TRANSITION PERIOD PROVIDED IN' <br />THE COMPREHENSIVE PLAN <br />FROM: David Greene REFERENCES: <br />Acting County Administrator <br />DESCRIPTION AND CONDITIONS: <br />On December 28, 1982 the Wilmoths submitted a site plan applica- <br />tion for a retail sales facility to be located at 725 27th <br />Avenue, S.W, Being submitted prior to the adoption of the Land <br />Use Element of the Comprehensive Plan, the application is a <br />•L.ransition petition and may be approved if adjudged compatible <br />with either the 1975 or 1982 Comprehensive Plans. The site <br />plan application was discussed on January 28, 1982 in the <br />regular meeting of the Planning and Zoning Commission. Staff's <br />position is that a retail sales facility is not compatible with <br />the 1975 Plan, which designates the site as low density (0-3 <br />units/acre) or the 1982 Plan, which designates the site as LD -1 <br />(up to 3 units/acre). The Planning and Zoning Commission in <br />a unanimous decision, allowed the applicant 30 days to ammend <br />the application so that it would be compatible with either the <br />1975 or 1982 Comprehensive Plans. Prior to the expiration of <br />the 30 day period, the Applicant's attorney, Mr. Jerome Quinn, <br />requested the application, which had not been ammended, be brought <br />again, before the Planning and Zoning Commission. On February <br />25, 1982 in the regular meeting of the Planning and Zoning Com- <br />mission, the application was denied unanimously. <br />The Planning and Zoning Department received a letter of appeal <br />from the applicants attorney on March 4, 1982. Included in the <br />letter is a request for a 60 day extension of the transition <br />period as provided in the 1982 Land Use Element. The current <br />60 day period will expire on March 19, 1982 and a 60 day ex- <br />tension will expire on May 18, 1982. <br />RECO111MENDATION : <br />1) <br />2) <br />The County Commission set a public hearing date of April 21, <br />1982 to hear the appeal. <br />A sixty day extension of the transition period be granted. <br />
