The Board continued to discuss the transition period; <br />how it would apply to site plan approval on any of the lots <br />in question; and whether they would have to obtain site plan <br />approval within that time in order to be valid. It was <br />Attorney Brandenburg's interpretation that they would, and <br />that in the case of duplexes, they would be asking for <br />approval of a site plan contrary to the CLUP. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Fletcher to reject the request for an extension <br />of the 60 day transition period. <br />Commissioner Bird noted, for the record to be accurate, <br />that he did believe after looking at the map that. Mr. <br />DeJoia's property was in the medium density area. <br />Mr. Challacombe informed the Board that this map is <br />questionable in concerns of scale. Estes Street is not <br />shown, and if you take a line drawn from the municipal <br />airport, the DeJoia property would be in low density; <br />however if Elaine St. is scaled properly, it would be in <br />medium. On the new map 80th Avenue is the line between LD -1 <br />and MD -1. <br />In further discussion on the transition period, <br />Commissioner Bird noted that the 60 day extension then <br />actually would not do Mr. DeJoia any good because he would <br />have <br />to <br />sell <br />all <br />the <br />lots <br />within this period and they <br />would <br />have <br />to <br />come <br />in <br />and <br />get <br />final approval; this would <br />not <br />create a problem for single family which does not require <br />site plan approval, but it would for structures such as a <br />duplex. <br />Chairman Scurlock called for the question on the Motion <br />to deny the 60 day extension. It was voted on and carried 3 <br />to 2 with Commissioners Bird and Wodtke voting in opposi- <br />tion. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Fletcher, to approve the staff recommendation <br />45 <br />APR 7 1982+ �� <br />
