ORDINANCE NO. 85-90 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP <br />FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County COF-missioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Connissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens Nwere heard; <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian, River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />COMMENCING AT THE S.E. CORNER OF THE N.E. 1/4 OF <br />SECTION 13, TOWNSHIP 33 SOUTH, RANGE 39 EAST RUN N <br />89°16'35" W ALONG THE QUARTER SECTION LINE OF DISTANCE <br />OF 72.74 FEET TO THE TRUE POINT OF BEGINNING. THENCE <br />CONTINUE ALONG SAID QUARTER SECTION LINE A DISTANCE OF <br />439.78 FEET TO THE EAST RIGHT-OF-WAY LINE OF INDIAN <br />RIVER BLVD.; THENCE NORTHEASTERLY ALONG SAID EAST <br />RIGHT-OF-WAY LINE HAVING A DELTA OF 34°38'00", A RADIUS <br />OF 647.96 FEET; AN ARC LENGTH OF 391.67 TO A POINT <br />LOCATED 570 FEET EAST (AS MEASURED AT A RIGHT ANGLE) TO <br />THE EAST RIGHT-OF-WAY LINE OF U.S. HIGHWAY # 1 SAID <br />POINT ALSO BEING ON THE NORTH RIGHT-OF-WAY LINE OF <br />PROPOSED ACCESS ROAD CONNECTING INDIAN RIVER BLVD. AND <br />VISTA ROYALE GARDENS ENTRANCE ROAD; THENCE S 27°57'10" <br />E ALONG A LINE PARALLEL TO SAID EAST RIGHT-OF-WAY LINE <br />OF U.S. HIGHWAY # 1 (ALSO BEING THE NORTH RIGHT-OF-WAY <br />LINE OF SAID PROPOSED ACCESS ROAD) A DISTANCE OF 215.33 <br />FEET BACK TO SAID POINT OF BEGINNING. <br />ALL THE ABOVE DESCRIBED LAND LYING AND BEING IN INDIAN <br />RIVER COUNTY, FLORIDA <br />Be changed from RM -10, Multiple -Family Residential District, <br />to CG, General Commercial District. <br />All with the meaning and intent and as set forth and <br />described in said Zoning Regulations. <br />
