Attorney Jackson interjected that Rural Sanitation was <br />4 <br />paying a large sum to use the Sanitary Landfill. <br />Motion was made by Commissioner Fletcher, seconded by <br />Commissioner Wodtke, that the Board authorize that the 5% <br />franchise fee be stricken, and that there be no franchise <br />fee at all. <br />Commissioner Lyons stated that he would not vote for <br />V <br />that Motion but would vote for a lesser fee. He then <br />offered a substitute Motion that the fee be changed to 3%, <br />which would be consistent with the fee for cable. <br />The Motion died for lack of a second. <br />Commissioner Lyons amended the original Motion that the <br />Board substitute 3% for 5% and that it would also be <br />excluding the provision that there will be no franchise fee. <br />The Motion died for lack of a second. <br />The Chairman called for the question on the original <br />Motion made by Commissioner Fletcher. It was voted on and <br />carried with a vote of 4 to 1, with Commissioner Lyons <br />voting in opposition. <br />Chairman Scurlock reported that he would have been in <br />favor of the Motion that Commissioner Lyons was trying to <br />make, but he could not second it. <br />A lengthy, detailed discussion ensued regarding the <br />performance bond and the increase in the amount of insurance <br />indicated in Section 13. <br />Motion was made by Commissioner Lyons, seconded by <br />Commissioner Bird, that the Board agree to leave the <br />insurance and performance bond as written in the proposed <br />franchises. <br />After a brief discussion, it was felt that it would not <br />hurt the franchise if the performance bond was deleted. <br />
