ORDINANCE NO. 85-94 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP <br />FOR THE PROPERTY DESCRIBED HEREIN, AND PROVIDING <br />FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency o:i such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Cor-z-issioners has determined <br />that this rezoning is in conformance -with the Land Use Element of <br />the Comprehensive Plan of Indian, River County; and <br />WHEREAS, The Board of County Cc-_-issioners has held a public <br />hearing pursuant to this rezoning request, at Twhich parties in <br />interest and citizens werc heard; <br />NOW, THEREFORE, 5E IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the followine described property situated in Indian River County, <br />Florida, to -wit: <br />FROM THE NORTHWEST CORNER OF NORTHEAST QUARTER OF <br />SOUTHWEST QUARTER, RUN EAST ON THE QUARTER SECTION <br />LINE A DISTANCE OF 393.12 FEET TO A PIPE ON' THE <br />EAST RIGHT OF WAY LINE OF FLORIDA EAST COAST RAIL- <br />ROAD, SAID PIPE BEING THE POINT OF BEGINNING; <br />THENCE RUN SOUTH 22°57' EAST ALONG SAID RIGHT OF <br />WAY A DISTANCE OF 550.6 FEET TO A PIPE; THENCE RUN <br />NORTH 72°13' EAST A DISTANCE OF 828.9 FEET TO A <br />PIPE ON THE WEST RIGHT OF WAY LINE OF THE PRESENT <br />U.S. HIGHWAY #1 (OLD U.S. #1 RIGHT OF WAY); THENCE <br />RUN NORTH 27°16' WEST ALONG SAID RIGHT OF WAY A <br />DISTANCE OF 293.8 FEET TO A PIPE AT THE INTER- <br />SECTION OF SAID QUARTER SECTION LINE; THENCE RUN <br />WEST ON SAID QUARTER SECTION LINE A DISTANCE OF <br />870 FEET, MORE OR LESS, TO THE POINT OF BEGINNING; <br />LESS ROAD RIGHT OF WAY, ALL IN SECTION 17, TOWN- <br />SHIP 31 SOUTH, RANGE 39 EAST. ALL ABOVE DESCRIBED <br />LANDS LYING OR BEING IN INDIAN RIVER COUNTY, <br />FLORIDA. <br />Be changed from C-1, Commercial District, to RM -6, Multiple - <br />Family Residential District. <br />All with the meaning and intent and as set forth and <br />described in said Zoning Regulations. <br />
