JUN 16 1982 <br />LaFevers parcel. <br />4. CONDITION OF PURCHASE <br />Pro 50 <br />Seller acknowledges that the sale and purchase of <br />Subject Property is for the use and benefit of the public as a <br />right-of-way for County road purposes (extension of 8th Street); <br />and in the event the County does not acquire the other parcels <br />necessary to construct 8th Street between U.S. #1 and 6th Avenue, <br />or determines by final Board action prior to September 30, 1982 <br />not to construct said street at all, the obligations contained <br />herein shall be null and void and both Buyer and Seller shall be <br />forever released. <br />5. WARRANTY DEED, EXISTING MORTGAGE <br />Seller shall convey title to Subject Property in fee <br />simple, by warranty deed, free and clear of any and all encum- <br />brances, and shall deliver no later than closing absolute releases <br />from all existing mortgagees, including the purchase money mort- <br />gage in favor of Frank Barrett, personal representative, as <br />recorded at Official Record Book 578, page 885 of the Public <br />Records of Indian River County. <br />If, however, the Seller is unable to obtain absolute <br />releases from those persons interested in said mortgage recorded <br />in Official Record Book 578, page 885 of the Public Records of <br />Indian River County, Buyer agrees to accept title to the subject <br />premises subject only to that said mortgage and Seller agrees -=at <br />the time of closing to sign a separate agreement agreeing to con- <br />tinue to maintain and pay off said mortgage encumbrance and to <br />further agree to indemnify and hold the buyer harmless from any <br />and all liability arising under said mortgage. <br />6. OTHER PROVISIONS <br />The Standards for Real Estate Transactions, attached <br />hereto as EXHIBIT B, shall govern this agreement, provided that <br />only the following lettered paragraphs therein shall apply: A(1), <br />D, G, H. L, M, Q, R, S, U, V, W. <br />7. EXPENSES <br />Buyer shall pay all costs and expenses, including Mate <br />surtax and documentary stamps, associated with the recording of <br />BooK0 b 4 4 PAGE I <br />
