Greene <br />Assistant County <br />Administrator <br />SUBJECT: <br />RANDALL & <br />REQUEST TO <br />OF PINSON <br />REFERENCES: <br />DESCRIPTION AND CONDITIONS: <br />FILE: IRC-82-ZC-5 <br />1458 <br />EVA MAE DAWKINS <br />REZONE LOT 10 <br />SUBDIVISION <br />The applicant is requesting that Lot 10 of Pinson Sub- <br />division be rezoned from C-lA, Restricted Commercial to <br />=' R-1, Single Family Residential (6 units/acre). The site <br />is located on the northeast corner of 42nd Street and 20th <br />Place (just east of U.S. #1) . The Land Use designation of <br />the subject property is MD -1 (up to 8 units/acre). A <br />fifty acre industrial node is located in the vicinity of <br />North Gifford Road and South Gifford Road, east of U.S.#l. <br />ANALYSIS: <br />Approximately 15 single family homes are O.ocated to the <br />north, in Pinson Subdivision. Grove equipment is stored <br />and maintained at Knight's Grove Care to the south. East <br />of the site is groves and wooded acreage. Several single <br />family homes are located to the west, across U.S. #1, in <br />the remainder of Pinson Subdivision. <br />The homes within Pinson Subdivision are presently non- <br />conforming uses in the C -1A, Restricted Commercial district. <br />The applicant originally requested a permit to add a room <br />to an existing single family structure. Non -conforming <br />uses may not be expanded thus, the permit was not issued <br />and a rezoning application was filed. The request for <br />R-1, Single Family Residential zoning complies with the <br />MD -1 (up to 8 units/acre) Land Use designation of the subject <br />property. <br />STAFF POSITION: <br />1) The request complies with the Comprehensive Plan. <br />2) Pinson Subdivision is an established single family <br />neighborhood. <br />3) Residential zoning of the subject property and the re- <br />mainder of Pinson subdivision in the future would <br />leave adequate land to fill the 50 acre industrial <br />node designated for the area. <br />4) Staff recommends approval of the request to rezone Lot <br />10 of Pinson Subdivision from C-lA to R-1. The <br />Planning and Zoning Commission, at its regular meet- <br />ing held on April 8, 1982, voted unanimously to <br />recommend approval of the request to the Board of <br />County Commissioners. <br />5) Several other single family homes exist as non -conform- <br />ing uses in Pinson Subdivision. In order to avoid <br />a spot zoning and to bring these residences into <br />conformance with the Comprehensive Plan and Zoning <br />codes, the staff recommends that the Commission <br />initiate rezoning of the remainder of Pinson Sub- <br />division, on the east side of U.S. #1, from.0-lA <br />JUN 16 1982 <br />to R-1, Single Family Residential. <br />5 <br />
