Brandenburg REFERENCES: <br />County Attorney <br />The legislature of the State of Florida adopted House Bill 421 <br />which amended Florida Statutes §166.052 (copy attached for your <br />review) and authorized counties to establish code enforcement <br />boards. <br />The purpose of a code enforcement board is to promote the well- <br />being of the citizens of a county by providing an equitable, <br />expeditious, effective and inexpensive method of enforcing and <br />contesting the enforcement of -the various county codes including <br />but not limited to occupational licenses, fire, building, zoning, <br />sign, and related technical codes. <br />Under the provisions in the Florida Statute a county may create by <br />ordinance a local government -code enforcement board. The board <br />consists of seven members who are residents of the county whose <br />appointments follow the rules set forth in the ordinance establish- <br />ing the board. These individuals are appointed on the basis of <br />experience or interest in the fields of zoning and building con- <br />trol. The membership should include an architect, a businessman, <br />an engineer, a general contractor, a sub -contractor and a realtor. <br />The terms of the board members are staggered. <br />A code inspector would bring all matters of co -compliance to the <br />attention of the board. The board would then conduct a formal <br />hearing on the alleged violation. After the receipt of all testi- <br />mony and evidence, the board would reach a conclusion based upon <br />the record presented and issue an order affording the proper <br />relief. <br />The board would have the authority to adopt rules to conduct its <br />business, subpoena witnesses, take testimony, issue orders having <br />the force of law and may fine individuals who do not comply with <br />orders that are issued, $250.00 per day for each day the violation <br />continues. <br />I believe that a code enforcement board could be very useful in <br />Indian River County in the areas of zoning, building and utilities <br />code compliance and recommend that the County Commission consider <br />establishment of such a board. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Wodtke, to authorize the Attorney <br />to draft an Ordinance establishing a Code Enforce- <br />ment Board. <br />JUN 16 1982,BOOK. 50 P*EE $3 p <br />82 <br />
