RIVER COUNTY, <br />Respondent. <br />CONSENT ORDER <br />This Consent Order is made and entered into between the <br />STATE OF FLORIDA, DEPARTMENT OF ENVIRONMENTAL REGULATION, Petitioner, <br />and INDIAN RIVER COUNTY, Respondent. <br />The Department finds and Respondent admits -the following: <br />1. Respondent has purchased from Treasure Coast Utilities, <br />Inc., a Florida corporation, a sewage treatment plant located at or <br />near an area known as Wispering Palms a/k/a Dixie Gardens Subdivision, <br />Indian River County, Florida, and a community public water system <br />providing drinking water to more than 25 year-round residents of <br />the same subdivision with more than 15 service connections and <br />located southeast of the intersection of 7th Avenue Southwest and <br />Antiguia Lane, Vero Beach, Indian River County. <br />2. The sewage treatment plant has been the subject of <br />a <br />litigation in the case of State of Florida, Department of Environ- <br />mental Regulation v. Treasure Coast Utilities, Inc., Indian River <br />County Circuit Court Case No. 76-730. By Final Judgement entered <br />on April 8, 1980, attached as "Exhibit A," the sewage treatment <br />plant was concluded to be in violation of Chapter 403, Florida <br />Statutes, and the rules promulgated thereunder with regard to the <br />adequate treatment and disposal of domestic wastewater. <br />3. In addition, the public water system has been the <br />subject of litigation in State of Florida Department of Environmental <br />Regulation v. Treasure Coast Utilities, Inc., Indian River Circuit <br />
