F) This contract covers equipment in the attached schedule and such additional <br />equipment hereafter installed as part of the communications system. When new <br />equipment is added CVB will adjust this schedule listing such additional <br />equipment and the new schedule will then become a part of this contract, <br />superseding previous schedule. The contract price will be increased in <br />accordance with the unit rates listed in the attached schedule and the <br />effective date of such increase will be the first day of the next month. <br />G) CVB will maintain the equipment so that its performance will equal or <br />exceed published specifications. CVB, however, does not assume responsibility <br />for signal strength, signal to interference rations and/or signal conditions <br />beyond the control of CVB. <br />H) If circuit or component adjustments or alterations become necessary as a <br />result of changes in transmission standards, changes in or additions to band <br />assignments by the U.S. Government, or the licensing of communications systems <br />by the Federal Communications Commission, such work, if technically feasible, <br />will be performed by CVB upon Customer's request, as promptly as possible-, at <br />CVB's prevailing rates for labor and materials. <br />I) CVB shall not be responsible for modifying, making additions to or <br />modernizing the communications systems as the technical art progresses. Such <br />work, if technically feasible, will be performed by CVB upon Customer's <br />request as promptly as possible, at CVB's prevailing rates for labor and <br />materials. <br />J) If the communications equipment has been altered or repaired by others in <br />any way that in the opinion of CVB affects reliability or detracts from the <br />performance thereof or if the communications equipment has been subjected <br />to misuse through negligence or otherwise CVB will submit to Customer a <br />description of the work to be done and request Customer's consent to restore <br />the communications equipment to normal operating condition at CVB prevailing <br />rates for labor and materials. If Customer does not agree to have CVB <br />restore the communications equipment to normal operating condition CVB will <br />have the right to terminate its obligations under this contract. <br />K) CVB assumes no liability with respect to the installation, service and <br />maintenance of motor generators, batteries, or other devices required or <br />used for furnished power to the communications equipment, nor to the effects <br />ron transmission or reception produced.by or emanating from such power supplies <br />!_ unless such power supplies are included in the <br />attached schedule. <br />L) This agreement does not cover service or maintenance in connection with <br />remote control lines including lines supplied by Telephone companies. Services <br />required because of such lines and time required to localize trouble to such <br />lines will be billed at CVB's prevailing rates. <br />M) This agreement does not cover -service, maintenance or repair necessitated <br />by loss or damage resulting from any cause beyond the control of CVB', includ- <br />ing but not limited to loss incurred in transportation, or loss due to fire, <br />water, windstorm, hail lightning,"theft, or any other cause originating <br />outside the communications system. With respect to any such loss or damage <br />CVB will request Customers approval to restore the equipment to normal <br />operating condition at CVB's prevailing rates for labor and materials. If <br />customer does not agree to have CVB restore the communications equipment to <br />normal operating condition, CVB shall have the right to terminate its <br />obligation under this contract. <br />J U L 141992 � : � � 478 <br />
