was so scheduled; however, Commissioner Fletcher is not <br />present this afternoon, and neither is Attorney Block, who <br />represents Mr. Childers. <br />Chairman Scurlock reported that Commissioner Fletcher, <br />before leaving due to illness, had indicated to him that he <br />had no opposition to having a public hearing on <br />reconsideration of this matter. Chairman Scurlock informed <br />the Board that before the last hearing he informed Mr. <br />Childers that he was going to be out of town and suggested <br />that he approach the Board for consideration of having a <br />full Board present. <br />Discussion ensued as to how to deal with Mr. Childers' <br />request for reconsideration. <br />Dorothy Friberg of 2146 79th Avenue stated that her <br />attorney informed her that with a suit pending against the <br />County, there should be no hearing. <br />Attorney Brandenburg noted that was merely that <br />attorney's personal opinion, and there is no requirement one <br />way or the other. <br />Mrs. Friberg wished to know why she was not notified of <br />this hearing, and it was explained that this is not a public <br />hearing; if the Commission should decide to grant Mr. <br />Childers another hearing, the public will be duly notified <br />of that hearing. <br />Commissioner Bird stated that his position on this <br />matter last time was that the petitioner would have the <br />right to have his rezoning request heard by a full <br />Commission, and he still stood by his previous position. <br />JUL 211982 <br />ON MOTION MADE by Commissioner Bird, SECONDED <br />by Commissioner Wodtke, Commissioner Fletcher <br />being absent and Commissioner Lyons voting in <br />101 <br />�a�K 50 PA F 677 <br />
