SECTION 13. NOTICE <br />A. In the event the Community Development Director <br />• <br />determines a violation exists, a written notice of violation shall <br />be issued to the owner of the property. The notice shall <br />contain: <br />(1) The name and address of the owner. <br />(2) The street address when available or a description <br />of the building or land upon which the violation is occurring. <br />(3) A statement specifying the nature of the <br />violation. <br />(4) A description of the remedial actions necessary to <br />bring the development activity into compliance and a time schedule <br />for completion of such remedial action. <br />(5) A statement of the penalty or penalties that may be <br />assessed against the person to whom the notice of violation is <br />directed. <br />(6) A statement that the Community Development <br />Director's determination of violation may be appealed to the Beard <br />of Adjustments by filing a written notice of appeal within thirty <br />(30) days of service of notice of violation. <br />B. The notice of violation shall be served upon the <br />person(s) to whom it is directed either personally, in the manner <br />provided for personal service of notices by the const of local. <br />jurisdiction, or by mailing a copy of the notice of violation by <br />certified mail, postage prepaid, return receipt requested to :itch <br />person at his or her last known address. <br />SECTION 14. ENFORCEMENT <br />A. Any violation of this ordinance is a public nuisance <br />and may be restrained by injunction o; otherwise abated in a <br />manner provided by law. <br />B. In addition to or as an alternative to any penalfy <br />provided herein or by law, any person who violates the provisions <br />of this ordinance shall be punished by a fine of not more than <br />FIVE HUNDRED DOLLARS ($500.00) or by imprisonment in the county <br />jail for a period not to exceed sixty (60) days, or by both such <br />fine and imprisonment.
