<br />A RESOLUTION OF THE BOARD OF
<br />COUNTY COMMISSIONERS OF INDIAN
<br />RIVER COUNTY, FLORIDA, PROVIDING
<br />FOR CERTAIN PAVING AND DRAINAGE
<br />IMPROVEMENTS TO 13TH PLACE, FOR
<br />APPROXIMATELY THREE HUNDRED
<br />TWENTY-FIVE (32S) FEET EAST OF 37TH
<br />AVENUE PROVIDING THE TOTAL
<br />ESTIMATED COST, METHOD OF
<br />PAYMENT OF ASSESSMENTS, NUMBER
<br />OF ANNUAL INSTALLMENTS, AND LEGAL
<br />DESCRIPTION OF THE AREA SPECIALLY
<br />BENEFITTED.
<br />WHEREAS, the. County Public Works
<br />Department has received a public Im-
<br />provement petition, signed by more than two-
<br />thirds of the owners of property in the area to.
<br />be specially benefitted,TegYesting paving and
<br />drainage improvements to Min Place, for
<br />approximately three hundred twentY-five
<br />(325) feet east of 77th Avenue; and
<br />WHEREAS, the petition has been verified
<br />and meets the requirements of Ordinance $1-
<br />27, and design work Including coat estimates
<br />has been completed by the Public Works
<br />Department; and
<br />WHEREAS, the total estimated cost of the
<br />proposed improvements is 64666.91; and
<br />WHEREAS, the special assessment
<br />provided hereunder shall for any given record -
<br />owner of prop" within the area specially
<br />beaentted, be .in an -amount equal to that
<br />proportion of seventy-five percent (75 percent)
<br />of the total cost of the project which the
<br />number of lineal feet of road frontage owned
<br />by the given owner bears to the total number of
<br />lineal feet of road frontage within the area
<br />specialty benefitted, and shall became due and
<br />payable at the Office of the Tax Collector of
<br />Indian River County ninety (90) days atter the
<br />final determination of the special assessment'
<br />pursuant to Ordinance 81.27; and
<br />WHEREAS, Indian River County shall pay
<br />the remaining twenty-five percent Of percent)
<br />of the total cost of the project; and
<br />WHEREAS, any special assessment not paid
<br />• within said ninety (96) day period shall bear
<br />Interest beyond the due date at a rate
<br />established by the Board of County Com-
<br />missioners at the time of preparation of the
<br />final assessment roll, end shall be payable In
<br />two (2) equal installments, the first to be made
<br />twelve (12) months from the due date and the
<br />second to be made twenty-four (24) months
<br />from the due date; and
<br />WHEREAS, after examination of the nature
<br />and anticipated usage of the Proposed im-
<br />provement, the Board of County Com-
<br />missioners has determined that the following
<br />described properties shall receive a direct and
<br />special benefit from these improvements, to
<br />wit;
<br />Lots 6.15, Unit 1, as shown on the Plat of Lone
<br />Palm Park Subdivision, as recorded in Plat
<br />Book 1, Page 61, of the Public records of St.
<br />- Lucie County, now lying and being a part of
<br />Indian River County, Florida.
<br />NOW, THEREFORE, be H resolved by the
<br />Board of County Commissioners of Indian
<br />River County, Florida, as follows.
<br />1. The foregoing recitals are affirmed and
<br />ratified in their entirety.
<br />2. A protect providing for paving and
<br />drainage improvements to 13th Pace, for
<br />approximately three hundred twenty -lira
<br />(325) feet east of 27th Avenue, heretofore
<br />designated as Public Works Project No. 9126,
<br />is hereby approved subject to the terms
<br />outlined above and all applicable
<br />requirements of Ordinance 91-27.
<br />The foregoing resolution was offered by
<br />Commissioner — who moved its adoption.
<br />The motion was seconded by Commissioner-
<br />- and, upon being put to a vote, the vote was
<br />as follows:

<br />evidence upon which the appeal is to be basad.
