tree. <br />8) All cuts shall be made cleanly and at the base of <br />the branch or limb cut, except when done with respect to the <br />shaping of a hedge. <br />9) Red mangroves may be hedged down to a minimum height <br />of six (6) feet, providing the limitations in paragraphs 1 and 7 <br />above are not exceeded. <br />SECTION 10 <br />ADDITIONAL DUNE AND SHORELINE VEGETATION PROTECTION <br />In order to protect the natural vegetation and the main <br />dune bluff fronting on the Atlantic Ocean, the following <br />restrictions shall be observed: <br />A. No structure shall be located seaward of the Coastal <br />Construction Control Line established by the Department of Natural <br />Resources pursuant to Florida Statutes Chapter 161, as may be <br />amended from time to time, except as provided elsewhere in this <br />ordinance. This provision shall be construed to establish a local <br />setback ordinance within the meaning of Fla. Admin. Code Chapters <br />16B-25 and 16B-33, as may be amended from time to time. <br />B. Except as provided herein, encroachment or ingress <br />onto or any disturbance of the main dune or natural vegetation <br />seaward of the state Coastal Construction Control Line is <br />prohibited, including encroachment or disturbance caused by <br />individuals upon foot or by vehicle of any kind. <br />C. No structure, other than an elevated bridge or dune <br />crossover, or observation tower constructed in the interest of <br />public safety, may be located seaward of the Coastal Construction <br />Control Line and the design of any such allowed structure must be <br />approved in advance by the Department of Natural Resources, Bureau <br />of Beaches and Shores, or its successor, and the Public Works <br />Director of Indian River County, Florida. <br />D. Except as expressly provided in Subparagraph E, it <br />shall be unlawful for any person to operate, drive, or propel any <br />truck, tractor, bulldozer, grader, crane, automobile, motorcycle, <br />dune buggy, moped, minibike, all terrain cycle, or any other <br />vehicle seaward of the Coastal Construction Control Line; <br />-13- <br />
