ORDINANCE NO. 91 -48 - <br />language in bold type: <br />"The common areas and rights-of-way© are not <br />dedicated to the public and will not be <br />maintained, repaired nr improved by the <br />county." <br />JL7. The owner files a declaration of restrictions <br />prohibiting the voluntary division of land <br />encompassed within the project into lots that are <br />less than four and seven eighths (4 7/8) acres in <br />size unless such division is accomplished by filing <br />a plat approved by the county and meeting all <br />andards -required of subdivisi-ons— under—this <br />chapter. <br />JL8. The owner files an "affidavit of exemption" in the <br />public records prior to dividing the land which <br />shall contain: <br />a. A legal description of the land encompassed <br />within the project and a certified survey <br />depicting all parcels created by the division, <br />all private and public streets and easements; <br />b. The book and page number of the official <br />records of Indian River County where the items <br />required in paragraphs ® 4, 5 and 1L6 may be <br />found; and <br />C. approval of -t -he publ-ic works And community <br />development directors and the county <br />attorney's office. <br />Section 39: Section 913.07(5)(A) of Subdivisions and Plats is <br />hereby amended as follows: <br />(A) Procedure. After TRC approval of the preliminary plate (at <br />the time the preliminary P is scheduled --for Prnicing—nd <br />Zoning Commission consideration and approval), an applicant <br />may apply for a land development -permit and -follow either--af <br />the procedures identified in 913.07(5)(A) 1 or 2. No <br />construction may commence until the applicant obtains a land <br />development permit or land development permit waiver, pursuant <br />to section 913.07(5)(A). The public works director is hereby <br />authorized to waive, in writing, the requirement for a land <br />development -permit where no improvements delineated in Section <br />913.09 are required or where a required improvement(s) can be <br />provided via another application and review process. No land <br />development permit waiver may be issued unless an initial <br />concurrencv certificate has been issued for the project <br />ortion to be covered by the waiver. <br />1. Construction before final plat approval. The applicant <br />shall mit to the public works department cons tr <br />plans and specifications as required in section <br />913.07(5)(B) of this chapter together with a request for <br />a land development permit, or shall request a written <br />land development permit waiver. A copy of the deed and <br />letter of authorization from owner if different from the <br />applicant shall accompany the request. Upon issuance of <br />a land development permit, or written land development <br />permit waiver, construction may commence.
