ORDINANCE NO. 9 <br />(1i) In no case shall application of the above <br />criteria be allowed to result in the cutting <br />of any mangrove trunk, branch, or limb at any <br />point where the diameter of the trunk, branch <br />or limb is equal to or greater than three (3) <br />inches. <br />(2) No permit shall be issued for the trimming of mangroves <br />within any Indian River Lagoon Aquatic Preserve, unless <br />approval has been obtained from the Florida Department o <br />Natural Resources (FDNR). <br />(3) Verification of. Florida Department of Environmental <br />Regulations exemption or approval shall be provided by <br />the applicant to the reviewing environmental planner <br />prior -to -county -mangrove -alteration permit issuance. <br />ret n county mgrove alteration permit shall he required for <br />the removal of mangrove dead wood. The following <br />provisions shall apply to dead wood removal: <br />(a) No prop roots or pneumatophores, whether dead <br />or alive; shall be removed or damaged. <br />(b) The applicant or agent to perform the dead <br />wood removal shall be required to adequately <br />demonstrate, to the reviewing environmental <br />planner, knowledge of distinguishing live wood <br />from dead wood. <br />(c) A minimum of one foot of dead wood shall be <br />retained between each cut and remaining live <br />mood -en -a subjectmangrove. <br />(d) Dead wood debris shall not be Allowed to <br />damage existing live mangroves within the <br />area, as applicable. <br />(e) <br />Subsections 927.08(1)(&d), <br />927.08(2), and 927.08(3) of this chapter shall <br />apply to the removal of dead wood as well as <br />the alteration of mangrove live wood. <br />Section 45: Section 930.07(1)(f) of the Stormwater Management and <br />Floodplain Protection chapter of the land development regulations <br />is hereby amended to read as follows: <br />(f) The bottom of dry retention areas shall be sloped at a minimum <br />.-28 to a permeable drain._ A dry detention area shall have an <br />outlet device, and shall not be lower than the elevation of <br />the off-site receiving channel or water body unless protected_ <br />by a suitably designed flap gate. <br />Coding: Words in Xfs-. type are deletions from existing law. <br />Words underlined are additions. <br />SmeadSoft Reprint Date: Friday, August 23, 2013 - 12:40:25 - OfficialDocuments:646, Attachment Id 0, Page 42 <br />
