CONSULTANT'S REPORT OF BUILDING DEPARTMENT <br />ON MOTION by Commissioner Lyons, SECONDED <br />by Commissioner Bird, the Board unanimously <br />accepted the Consultant's Report on the <br />Building Department. <br />The Building Department 'Transfer. and Implementation <br />Plan for Indian River County is on file in the Office of the <br />Administrative Aide to the Board of County Commissioners. <br />CABLE TV ORDINANCE - PROPOSED AMENDMENT <br />The Board reviewed the following information: <br />TO: Members of the. Brandenburg REFERENCES: <br />County Attorney <br />The County Commission previously received a request to amend <br />Section 5 C. CHANNEL REQUIREMENTS, to limit the requirements of <br />providing free CATV service to schools and libraries. The <br />following are three (3) alternative approaches to the situation; <br />1. Retain present wording. The ordinance currently reads "If any <br />CATV subscribers are being served within a radius of one <br />quarter mile of a school or library, the licensee shall provide <br />basic CATV services to the school or library without charge; <br />provided, however, the installation charges shall be borne by <br />the school or library pursuant to and in compliance with the <br />provisions of this Ordinance." Thislanguage provides free <br />service to all schools and all libraries and raises the <br />question as to -what constitutes a school or library within the <br />meaning of the ordinance. The current ordinance does not <br />provide a definition for these two terms. <br />2. Change the wording of the ordinance to read "To schools that <br />are licensed to provide service in accordance with the <br />compulsory attendance law of the State of Florida and public <br />libraries." <br />;1 <br />This change would eliminate some of the ambiguity by limiting <br />the free service to public and private schools and all.other <br />homes, institutions, etc. that qualify under state law. <br />22 <br />
