Commissioner <br />1982- <br />2 <br />Commissioner Bird briefly reviewed events of the last <br />few months concerning the intended use of the park parcels <br />at Orchid Island. He had asked the Attorney to do research <br />and make a determination if the park parcels were dedicated <br />to the County or to the residents of the area. After <br />discussions and correspondence with Attorneys VanDeVoorde <br />and Henderson, this item was withdrawn from the last <br />meeting, but now it was back for the Board to make a <br />determination. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Bird, that the Board adopt <br />Resolution 82-86 formally accepting park <br />parcels on Orchid Island. <br />Roger Cooper, resident of Orchid Island, approached the <br />Board, and noted that the developer in the area_ had planned <br />for the park parcels to belong to the potential property <br />owners. He asked if the property owners or the County had <br />control of the lots. <br />Dr. Charles Holt, Orchid Island, came before the Board <br />and briefly discussed the confusion concerning the property, <br />and the property owners wanted to have clarification that it <br />was County -owned property. <br />Attorney Brandenburg noted that on the plats, the park <br />parcels were clearly dedicated to the public but that would <br />not preclude the Board from using, the parcel as a <br />neighborhood park. He suggested the resolution be utilized <br />because the dedication of the park was an offer, and unless <br />an act accepting it occurred, the offer would be <br />outstanding. Attorney Brandenburg added that because of <br />that, and the doubt it had created, he suggested the <br />resolution be adopted. <br />
