ORDINANCE N0: 91- <br />(2) Location of boatslips. Boatslips shall be permitted only as <br />a wet storage area adjacent to a dock, marina, boat livery, or <br />boat yard. Boats slips shall not encroach upon a riparian <br />side .yard setback as determined by the applicable zoning side <br />yard setback of the zoning district in which the project is <br />located, as extended waterward from the adjacent upland. No <br />portion _of -a -watercraft moored at such boats lip shall project <br />-.into the extended riparian side yard setback, unless necessary <br />to allow the utilization of riparian rights. <br />(3) Protection of Waterfront Structures <br />(a) Unwalled boat shelters. Unwalied boat shelters may be <br />erected over boatslips; however, 'nop art of such shelter <br />may be erected beyond the shoreline.p <br />unless the—following <br />conditions are met: <br />1. the.applicant shall provide a detailed inventory of <br />sea grasses and submerged aquatic vegetation.in the <br />area to reviewing county staff; <br />2. the applicant must demonstrate that the unwalled <br />boat shelter does not adversely impact light- <br />sensitive aquatic resources such .as seagrasses; <br />boat shelter and the terminal platform of the <br />associated dock shall not exceed Florida Department <br />of Natural Resources (FDNB) size limitations where <br />such structures are. located in an aquatic preserve, <br />"provided that in no case, however, shall the <br />-- surface area covered by an unwalled boat shelter <br />exceed 400 square feet; and <br />4. the height of the unwalled boat shelter shall not <br />exceed twenty (20) feet above mean high water. <br />(b) Extension of docks and piers in waterways; generally. <br />Docks and piers shall not project outward from the shore <br />more than twenty (20) percent of the width of the <br />waterway at a point w erethey—arelocated. The outward <br />projection of a dock shall be measured from the water's <br />dimensions,edge at mean low tide. The location, <br />and <br />structural character of all structures shall be in <br />conformity with applicable federal and state <br />jurisdictional agency regulations. <br />(c) Tie -off piles, -mooring or dolphin poles. Tie -off piles <br />and_m2oring or dolphin poles may extend into a waterway <br />a maximum of twenty-five (25) percent of the width of the <br />waterway. ' Boat lifts attached to a dock shall be <br />permitted between the dock and the tie -off piles, and/or <br />mooring or dolphin poles. Notwithstanding, all such <br />structures shall comply with.applicable federal and state <br />jurisdictional agency regulations. <br />(d).Application of paragraphs "b" and "c" above shall not <br />result -in -an -unobstructed waterway --of less -than twenty- <br />five (25) feet in width (twelve. and one-half (121) feet <br />either side of the waterway centerline). <br />(4) Riparian side yard setback encroachment prohibited.
