ORDINANCE NO. 92 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING <br />THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM <br />A-1 TO RS -3 AND RM -6, FOR THE PROPERTY GENERALLY LOCATED <br />EAST OF 90TH AVENUE, BETWEEN 8TH STREET AND 12TH STREET, <br />AND DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. <br />wHEREAS,—the-Planning-and-Z-oni-ng-CommissionI s=ttzng-as- the <br />local planning agency on such matters,has helda public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that <br />this rezoning is in conformance with the Comprehensive Plan of <br />Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by -the Board ofCount <br />commissioners of Indian River county, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />Parcel 1: <br />An undivided one-half interest in and to the following <br />described property: The West 10 acres of the east 20 <br />acres of Tract 12, Section 11, Township 33S, Range 38E, <br />Indian River Farms Company, according to the last general <br />plat filed in the off of the Clerk of the Circuit Court <br />of St. Lucie County, Florida, in Plat Book 2, Page 25, <br />said -fid now lying and -be ngin--Indian River County, <br />Florida. Said parcel containing i10 acres; and <br />Parcel 3: <br />Commencing at the Northwest corner of Tract 12, Section <br />11, Township 33S, Range 38E; thence along the center <br />section line North 89°43101" East 656.60' to the Point of <br />Beginning. From the Point of Beginning parallel to the <br />West line of Section 11 South 0005100" West 1326.43' to <br />a point on the South line of Tract 12; thence along the <br />South line of Tract 12 North 89038'11" East 19.82' to.a <br />point; thence parallel to the East line of Tract 12 North <br />0000'13" East 1326.40' to a point on the center Section <br />line; thence along said center Section line South <br />89o43101" 19.94' to the Point of Beginning.
