ORDINANCE NO, 90- <br />(a) In the event that any officer hasprobable <br />---------------------------- <br />cause to bel leve a dog is vicio�ht-shal+—c-onduet -a1 <br />investigation. If the officer is satisfied -after--such <br />investigation that the dog is vicious as defined in this <br />chapter, he shall declare the doa- as-a-ci <br />vious dog and <br />pPrope -r1y—r taf_y-flip-owner-of_the___do�__ in—ting of such <br />declaration. If a determination -has been -made that -a-dot -II <br />s <br />vicious, the owner shall comply with -the provision -of-this <br />section within thirty (30) -days -of such determination. -If <br />the owner of the dog contests the determination made -by the <br />officer, he -or she -may, _within --five _(5) -days of -such <br />determination_ appeal -the declaration of viciousness -to -the <br />Director of Department _of -Emergency_ Services- by -way --of <br />written notice. The Director shall 'decide the issue based <br />upon- the -preponderance- of -the evidence._if_ the�irector- <br />determines that the dog is vicious, the Director may <br />establish a time schedule to ensure compliance with -,this <br />chapter -in -no case more than -fifteen (15) days -subsequent -to <br />the-Directorl-s-fete-rm+nat-i-Gn-. -A1-1-1:hemie-te-minations of the <br />Director should be in writin9_, signed -and- dated - by the <br />Director, and should contain the finding of factssupporting <br />the determination.
